The Durban Magistrates Court has granted the state a final postponement until February 7 next year, in the murder case of rapper Kiernan ‘AKA’ Forbes and Tebello ‘Tibs’ Motsoane, to draw up an indictment. Forbes and Motsoane were gunned down outside a restaurant in Durban in February last year.
Five men have been charged with the murder.
Two other suspects, brothers Siyabonga and Malusi Ndimande are in eSwatini where their extradition is still before the courts.
Magistrate Vincent Hlatshwayo, however, did refuse an application by the state to postpone the case for the finalization of the Ndimande brothers’ appeal against the extradition.
He said: “It is so that it would be in the interest of justice and convenience that the accused who allegedly committed an offense together, be tried together, but if that is not possible, hard luck.”
“Moreover, on the last appearance when the matter was postponed to today, the state placed on record that whether these accused are available or not, the state would be able to proceed with the case against the accused before the court, ” Hlatshwayo added.
